| Kauai may allow agriculture land vacation rentals Posted: 29 Jun 2010 07:32 PM PDT LIHUE, Hawaii (AP) - A Kauai County Council bill that would legalize hundreds of existing vacation rentals on agricultural lands is gaining ground. The bill proposed by Councilman Tim Bynum would give vacation rentals operating on land zoned for agriculture an opportunity to apply for a permit. Several people spoke in favor of the bill at a June 23 public hearing, many of whom were lawyers and real estate managers representing vacation rental owners. A small number of opponents spoke against the bill. Lihue attorney Dan Hempey said his client, the Kauai Alternative Vacation Accommodation Association, said the bill is good because it promotes farming. Hempey said vacation rental owners would need employees to work the farm. The county would also have to set an acceptable ratio between vacation rental income versus farming income so the county could disqualify vacation rentals disguised as farms. "I think we've got to trust our bureaucrats to look at it and make a decision whether this is a scam application or a real application," Hempey said. Chad Deal said the bill allows for regulation and treats everyone fairly. Deal said vacation rentals on farms offer tourists an opportunity to experience the island in a different way. He related his daughter's experience last Christmas in Italy as an example. She stayed in a farm there, along with 60 other tourists, and was put in charge of baking. But opponents said vacation rentals don't belong on agricultural land. George Volker said his neighbors on agricultural land have been conducting an illegal vacation rental business for years. They've had many parties on their properties, with bands playing and film crews. Volker filed a complaint with the county Planning Department but both vacation rentals continue to operate. A tearful Anne Punohu said if she had a piece of land to farm she would be able to support her family much better, but instead she has to work at department stores and in the tourism industry. "The land on the beach side is very fertile if you know how to farm, and if you know what to farm," Punohu said. Two years ago, Kauai passed a law creating a path for vacation rental owners to legalize their operations by applying for permits. But this measure specifically excluded those operating on agriculture land. Bynum, the bill's sponsor, and Councilman Jay Furfaro both say the bill is an attempt to fix the law. The agriculture vacation rentals would have to have been operating before March 7, 2008 to qualify for the new permits. The county Planning Commission approved the bill in April.
